Debate: does a hobby farm need a business license before the first egg gets sold?
A county clerk in Frederick told me last Tuesday that selling 3 dozen eggs a week from my backyard counts as a farm product sale, which means I skip the expensive business license I was about to buy. My neighbor swears you still need one the second money changes hands, even at $5 a carton, and now I am stuck in the middle of two very confident people. Which side is right here, and does selling jam or bread out of the same kitchen change the answer?
I ran into the same thing in Loudoun County with 4 dozen eggs a week, and the ag office told me farm product sales get an exemption without any license. Once you add jam or bread though, it becomes a cottage food item and the rules turn, so check with your county health dept on that part.
